Nunn, DO, NC Medical License #36123 for participation in federal programs. According to information obtained from the North Carolina Medical Board’s webpage, Dr. Nunn’s practice site is Community Wellness Center, 750 McCarthy Boulevard, New Bern, NC 28562. The Office of Inspector General of the US Department of Health and Human Services lists Dr. Nunn on its Exclusion List.             <description>Food and Drug Administration (FDA) is reminding health care providers to obtain and use only FDA-approved injectable cancer medications purchased directly from the manufacturer or from wholesale distributors licensed in the US. FDA’s inspection of the Novartis manufacturing facility found a packaging problem that may result in a pill, tablet or caplet getting mixed in with a different prescription.             <description>The North Carolina Division of Medical Assistance has designated Roche as its supplier of diabetes supplies for North Carolina Medicaid patients.  Pharmacists have inquired whether a switch from Prodigy products (the prior DMA-approved provider) to Roche products requires a new prescription.  Board staff deems substitution permissible without a new prescription.  Board staff strongly advises pharmacists, however, to counsel patients receiving Roche supplies for the first time to reduce confusion, ensure proper use, and promote good health outcomes.</description>

            <title>CARISOPRODOL PRODUCTS BECOME SCHEDULE IV CONTROLLED SUBSTANCES JANUARY 11, 2012</title>
            <description>Effective January 11, 2012 all carisoprodol products will become Schedule IV controlled substances under federal law. Pharmacists should note that federal Controlled Substances Act regulations require any DEA registrant (i.e., a pharmacy) that possesses any carisoprodol stock must take an inventory of all stocks of carisoprodol on hand on or before January 11, 2012.             <title>Questions Regarding S.L. 2011-349, Photo Identification Prior to Dispensing Certain Controlled Substances</title>
            <description>As reported in Item 2227 of the October 2011 Newsletter, the North Carolina General Assembly passed, and Governor Perdue signed into law S.L. 2011-349, which requires presentation of a photo identification prior to the dispensing of certain controlled substances.  The statute is an amendment to the North Carolina Controlled Substances Act and codified at N.C.G.S. § 90-106.1 and is effective March 1, 2012.  Board staff has received numerous questions about this statute.  In response, Board staff has developed an FAQ document.  Because this law is part of the NC CSA, the Drug Control Unit of the North Carolina Department of Health and Human Services also has administrative responsibilities for the statute.             <description>The North Carolina Board of Pharmacy has proposed amending 21 NCAC 46 .2507 (d) to enable pharmacists with physical disabilities to perform vaccinations by removing the requirement that the pharmacist hold a CPR certification, while continuing to protect the public welfare by ensuring the presence of a CPR-certified pharmacist or technician.

A public hearing will be held on January 9, 2012 at 5:00pm at the NC Board of Pharmacy office, 6015 Farrington Road, Suite 201, Chapel Hill, NC 27517.

            <title>Governor Purdue Signs S609, Which Authorizes Pharmacists to Administer Flu Vaccine to Patients 14 and Older</title>
            <description>Yesterday, Governor Perdue signed into law S609, which provides in part:  “A pharmacist licensed under Article 4A of Chapter 90 who may administer vaccines under 21 NCAC 46 .2507 and 21 NCAC 32U .0101 shall be granted the authority to administer influenza vaccine to patients aged 14 years and older pursuant to 21 NCAC 46 .2507 and 21 NCAC 32U .0101.”  This provision was effective immediately upon Governor Perdue’s signature.  Accordingly, pharmacists presently authorized to administer vaccines under existing Board rules may begin administering flu vaccine to patients 14 and older.</description>

            <description>The FDA announced yesterday that Avandia, Avandamet, and Avandaryl will not be available for dispensing from retail pharmacist after November 18, 2011.  FDA’s actions comes as a result of its modification of the Risk Evaluation and Mitigation Strategy (REMS) for these drugs.             <title>PRESCRIPTIONS FROM GEORGIA-BASED “PAIN CLINICS”</title>
            <description>Board staff has received numerous calls from pharmacists in North Carolina concerning prescriptions from “pain centers” in Georgia.  As with prescriptions of similar ilk from Florida, the typical presentation is a patient from outside of North Carolina (though this is not exclusively so) present prescriptions for various narcotics and other controlled substances from a “pain clinic” in Georgia.  If the pharmacist contacts the Georgia facility, he/she is typically unable to speak with the prescriber, but is “assured” by someone in the office that the prescription is “legitimate.”  Most, if not all, such prescriptions appear to not be written for a legitimate medical purpose in the ordinary course of medical practice.  Pharmacists should be appropriately cautious.</description>

            <description>Many pharmacists are aware that the FDA approved Makena, a hydroxyprogesterone caproate injection, to be marketed by KV Pharmaceuticals.  Significant press coverage has focused on KV Pharmaceuticals&apos; decision to price that injection at over $1,500 per dose when compounded versions were available at $10 to $15 per dose.             <title>Update on Technician Rulemaking</title>
            <description>MONDAY, JUNE 21, 2010

UPDATE ON TECHNICIAN RULEMAKING.  As many pharmacists are aware, the Board proposed and adopted a rule that would allow pharmacy technicians working in an acute-care hospital environment and holding an associate’s degree in pharmacy technology to take on additional duties and provide greater assistance to pharmacists in the areas of unit-dose packaging and certain unit-, cart-, and floor-stocking.  The Board adopted the rule at its May 2010 meeting.  The North Carolina Rules Review Commission then raised objections to the rule.  At its June 17, 2010 meeting, the RRC determined that the Board had overcome all of those objections.  Ordinarily, the new rule would take effect.  In this instance, however, approximately ten people have written to the RRC expressing objections to the rule and requested legislative review of its terms.  Therefore, by operation of state law, the rule – though adopted by the Board and cleared by the RRC – cannot become effective until the North Carolina General Assembly has had a certain number of days in which to introduce a bill to nullify the rule should any legislator desire to do so.             <title>DEA Issues &quot;Interim Final Rule&quot; on Electronic Prescriptions for Controlled Substances</title>
            <description>FRIDAY, MARCH 26, 2010

DEA ISSUES “INTERIM FINAL RULE” ON ELECTRONIC PRESCRIPTIONS FOR CONTROLLED SUBSTANCES. On Wednesday, March 24, 2010, the DEA issued an “interim final rule” concerning electronic prescriptions for controlled substances. This rule, which will not go into effect until May 24, 2010 at the earliest, is lengthy. Pharmacists should begin reviewing the rule and, particularly, contacting your software and hardware vendors to discuss the security and other requirements that DEA specifies for receipt of electronic controlled substance prescriptions. Board staff has begun a review of the rule and hopes to provide an FAQ on certain aspects in the coming days. In the meantime, the text of the interim final rule may be found here. Note that the document is long (334 pages). Most of the document is devoted to responding to comments DEA received on its proposed rule in 2008.</description>

PRESCRIPTIONS PRESENTED FROM FLORIDA “PAIN CLINICS”. Board staff has become aware that, once again, waves of patients are presenting prescriptions for oxycodone and other controlled substances written by doctors in “pain clinics” located principally in Florida. Pharmacists are advised that such prescriptions are typically invalid – they are not written for a legitimate medical purpose in the usual course of medical practice. Pharmacists should use their professional judgment when presented with such prescriptions and should strongly consider notifying local law enforcement when presented with them.</description>

            <title>Pharmacist administration of seasonal and H1N1 flu vaccine to patients age 14+</title>
            <description>EFFECTIVE OCTOBER 9, 2009, PHARMACISTS WILL HAVE TEMPORARY AUTHORITY TO ADMINISTER SEASONAL AND H1N1 FLU VACCINE TO PATIENTS AGE 14 AND OLDER.  Pursuant to a request from Dr. Jeffrey Engel, State Health Director, the Pharmacy and Medical Boards have passed an emergency amendment to the pharmacist vaccination rule authorizing pharmacists to administer seasonal and H1N1 influenza vaccine to patients age 14 and older.  The effective date of this amendment is Friday, October 9, 2009.

This authority is, at present, temporary, and it is expected that the authorization will extend through July 2010, unless a permanent rulemaking is begun prior to that date. Dr. Engel’s request to the Pharmacy and Medical Boards stated that the North Carolina Division of Public Health (DPH) “has concluded . . . that the age restriction contained in the pharmacist vaccination rules will impair DPH’s ability to fulfill its mission to protect the public health and safety of North Carolina’s citizens.  Indeed, pediatric patients are among the members of the North Carolina public most susceptible to particularly serious complications from novel H1N1 infection.”   DPH intends to “enlist the aid of pharmacist vaccinators across the state to meet this serious, urgent need.”</description>

            <title>Judicial Order Concerning Access to Prescription Records by the Sheriff of Cherokee County or Agents of the Multiple Agency Narcotics Unit</title>
            <description>Board staff recently learned that Resident Superior Court Judge James Downs of North Carolina Judicial District 30A (which encompasses Cherokee, Graham, Clay, Macon, and Swain Counties) issued an order on January 5, 2009 that authorizes Agents of the Multiple Agency Narcotics Unit apparently coordinated by the Cherokee County Sheriff’s office to have access to pharmacy records relating to any case in which Controlled Substance violations are related to prescription drugs.
