Q: Is there a rule that addresses proper disposal of patient information/prescription records?

A: 21 NC 46 .2305 addresses the security of confidential patient information. Furthermore, the federal HIPAA statute sets strict requirements for protecting, and disposing of, “personal health information” or “PHI”, which prescription records are.

Please see this recent memo from NAPB reminding pharmacists of the importance of proper handling of patient information. It’s been brought to NABP’s attention that pharmacies across the country have become lax in their management of patient data; this serves as a reminder to all pharmacists that patient data must be secured and discarded properly.
